Terms of service

Last updated 10 October 2026

These terms are the agreement between you and Malya LLC for your use of Clarity. We have kept them short and in plain language. If anything is unclear, just ask us.

1Who this is between

“Clarity”, “we” and “us” mean Malya LLC, a Texas limited liability company. “You” means the person or company that holds the account. If you accept these terms on behalf of a company, you are saying you are allowed to.

2Your account

You are responsible for what happens under your account, including what the people you invite do with it. Keep your sign-in details private, let us know if you think someone else has used them, and give us an email address that reaches a real person.

You must be able to form a binding contract where you live, and you must not use Clarity if we have previously closed your account for breaking these terms.

3Your data stays yours

Photos, surveys, design surfaces, measurements and anything else you put into Clarity remain yours. We do not claim ownership of them and we do not sell them.

You give us the narrow permission we need to run the service: to store your files, to process them into the outputs you asked for, to show them back to you and to anyone you share them with, and to keep backups. That permission ends when you delete the data or close the account, apart from copies in backups, which are cleared out on a regular schedule.

You confirm you have the right to upload what you upload — including permission to fly and image the sites in question.

4What we provide, and what we don't

Clarity produces measurements from imagery. Those measurements depend on how the flight was flown — resolution, overlap, and whether ground control was used. We show each flight’s resolution, and each volume’s base surface and how much of the area you drew was measured, so you can judge it.

Clarity is not a substitute for a licensed surveyor, and a number it produces is not a certified survey. Where a jurisdiction, a contract or a payment depends on a certified figure, have a qualified professional check it. You are responsible for decisions you make from what Clarity tells you.

5Paying

The Explore plan costs nothing and is never charged. It does not need a card, and we will not invoice you for it.

Studio is a monthly subscription at the price shown on the pricing page when you subscribe, in US dollars, charged in advance to the card you give our payment processor. It renews each month until you cancel. You can cancel at any time from Settings, under Plan and billing; the plan then runs to the end of the month already paid for and is not charged again. We will not raise the price of a subscription without telling you at least 60 days beforehand.

Processing credits are bought in advance at the price shown when you buy them and are valid for twelve months from purchase. A flight is charged in credits when it is queued, by the number and size of its photos, and the number is shown before you upload. A flight that fails or that you cancel gets its credits back.

Enterprise and anything else agreed with us directly is set out in a written order — what is covered, the term, the fee. That order and these terms are the whole agreement; where the order says something different, the order wins. Fees under an order are invoiced in advance for the term and are due within 30 days unless the order says otherwise, and a term renews for the same length unless either of us says otherwise at least 30 days before it ends.

Taxes are yours where they apply. If we have charged you something we should not have, write to service@malya.io and we will put it right.

If a Studio subscription ends, the organisation moves to Explore automatically: your sites stay readable; uploads, new share links, invitations and exports stop until you subscribe again. If an invoice is more than 30 days late we may suspend processing while leaving your data readable, and we will tell you before we do. Nothing is deleted for non-payment without written notice and a reasonable chance to export.

6Acceptable use

You agree not to:

  • upload imagery you do not have the right to upload;
  • try to reach data belonging to another organisation;
  • probe, scan or load-test the service without asking us first;
  • resell Clarity as your own service without a written agreement;
  • use it to break a law that applies to you.

If an account does one of these, we may suspend it, and we will tell you why.

7Availability

We work to keep Clarity running and to process flights promptly, but we do not promise a specific uptime or turnaround on these plans, and processing times vary with the size of a flight and the queue. Planned maintenance will be announced where we can.

8Ending it

You can close your account or your organisation at any time by contacting us at service@malya.io. Please export anything you want to keep first, as closing an organisation removes its sites and flights for good.

We may end this agreement if you break these terms and do not fix it within 14 days of us telling you, or immediately if the breach is serious. If we end it for our own convenience we will refund the unused part of what you paid.

9Liability

To the extent the law allows: Clarity is provided as it is, and we exclude the implied warranties we are permitted to exclude. We are not liable for indirect or consequential loss, or for lost profit, revenue or data.

Our total liability to you in any twelve-month period is limited to what you paid us in that period. Nothing here limits liability that cannot lawfully be limited.

10Changes, and where disputes go

We may update these terms. If a change matters we will email the account address at least 30 days first, and continuing to use Clarity after that means you accept it. If you do not, cancel before it takes effect.

These terms are governed by the laws of the State of Texas, and the courts of Harris County, Texas have jurisdiction.
